The small print
This is a subset of our
standard testing contract as relates to independent testing projects,
product approval and
publication of materials on our Web site:
- The
NSS Group accepts products for evaluation, certification and/or
approval on the strict understanding that all features, benefits,
advantages and flaws in those products will be reported fully and
accurately. The vendor will have the opportunity to examine the final
reports for technical inaccuracies, but will have no right to insist
on changes of any kind. We reserve the right to make subjective
comments based on our experience of the market place and competing
products. In submitting products for testing, the vendor agrees to
waive all rights to take any action against The NSS Group as a result
of publication of its findings, and further agrees not to seek to
prevent publication in any way. The NSS Group accepts no liability for
any actions or consequences arising from the publication of test
results.
- NSS
certification or approval does not warrant a product for fitness of
purpose in any given environment, nor does it guarantee a given level
of functionality. Certification implies only that a product has passed
a given set of test criteria (as published on our Web site) when
configured as specified. All awards (such as NSS Approved and NSS Gold
Awards) are purely discretionary and awarded on merit, based on the
subjective and professional opinion of The NSS Group testing
personnel. Certification or approval applies only to the product
version tested (with vendor-recommended updates or service packs
applied), configured as per the vendors recommendations, running on
a specific version of the operating system (with latest service packs
applied at the time of testing), and on the hardware platform in our
laboratory test-bed. The NSS Group cannot guarantee the product will
behave as reported by us in any other environment or configuration.
- The
NSS Group provides no written or other contractual guarantee following project
completion that the Vendors product(s) are or will be bug
free, functionally sound or otherwise free from anomalies or
bugs of any kind. The NSS Group disclaims and excludes any and
all implied warranties of merchantability, title and fitness for
particular purpose.
- The
Vendor may mention The NSS Group name and utilise NSS Certification or
other corporate logos as provided by NSS in association with test
results in Vendor advertisements or press releases. The NSS Group must
approve Vendor copy in writing prior to publication. This includes any
initial or subsequent use of NSS logos in any Vendor advertising,
brochures, flyers, etc. Certification and Approved logos may only be
used against those products that have been tested and approved by The
NSS Group. The Vendor undertakes not to imply that certification or
approval applies to any other products.
- The
NSS Group retains ownership and copyright of the output from all
testing projects, and reserves the right to publish and distribute
reports as it sees fit, both in print and on-line.
- The
information contained in The NSS Group reports and on The NSS Group
Web site is believed to be accurate and reliable at the time of
writing, but cannot be guaranteed to be correct or complete. The NSS
Group shall not in any case, be liable for any special, incidental,
consequential, indirect or punitive damages related to testing
services or publication of reports or the subsequent use of
information contained therein, even if NSS has been advised of the
possibility of such damages.
- The
NSS Group is not responsible for lost profits or revenue, loss of use
of software, loss of data, costs of re-creating lost data, the cost of
any substitute equipment or program, or claims by any party in
relation to its testing services, publication of reports and results,
or use of that information by any party.
